Family-Based Visas

Reuniting Families Through Immigration

Family-based immigration allows U.S. citizens and lawful permanent residents (green card holders) to sponsor relatives for visas and permanent residency. If you want to bring a loved one to the United States, understanding the process is essential. An experienced immigration attorney can help you navigate the complexities and avoid unnecessary delays.

Who Can Apply for a Family-Based Visa?

Family-based visas fall into two main categories:

Immediate Relative Visas (Unlimited Quotas)

For U.S. citizens sponsoring:

  • Spouse (IR-1)
  • Unmarried child under 21 (IR-2)
  • Parent (if the sponsor is 21 or older) (IR-5)

Family Preference Visas (Limited Numbers Available)

For U.S. citizens and green card holders, these visas are subject to annual caps:

  • F1 – Unmarried adult children (21+) of U.S. citizens
  • F2A – Spouses and minor children of green card holders
  • F2B – Unmarried adult children (21+) of green card holders
  • F3 – Married children of U.S. citizens
  • F4 – Siblings of U.S. citizens (if the sponsor is 21 or older)

The Family-Based Visa Process

  1. Petition Filing – The U.S. citizen or green card holder files Form I-130 (Petition for Alien Relative) with USCIS.
  2. Petition Approval & Wait Times – Immediate relatives proceed to visa processing; preference categories may wait years due to quotas.
  3. Visa Processing & Interview – The National Visa Center (NVC) processes the case, followed by an interview at a U.S. consulate abroad.
  4. Visa Issuance & Entry to the U.S. – Once approved, the family member can enter the U.S. and obtain a green card.

How an Immigration Attorney Can Help

While the process may seem straightforward, delays, denials, and complications are common. An immigration attorney can:

  • Ensure accurate petition filing to avoid delays or rejections.
  • Handle complex cases involving prior immigration violations or inadmissibility issues.
  • Prepare for consular interviews to prevent visa denials.
  • Assist with adjustment of status for relatives already in the U.S.

Having professional legal guidance increases the chances of success and minimizes stress.
